This User Agreement (“Agreement”) governs the access and use of services provided by TravelDekho Services Pvt. Ltd., operating under the brand name “TripDekho” (hereinafter referred to as the “Platform”).
By accessing the Platform, browsing, or completing any booking, the User expressly agrees to be legally bound by this Agreement.
2. Platform Role
The User expressly acknowledges and agrees that:
TravelDekho (TripDekho) is solely a technology-based aggregator and intermediary platform
The Platform does not own, manage, control, or operate any travel services
All travel services are provided by independent third-party vendors
The Platform's role is limited to:
Providing listing and discovery
Facilitating bookings
Enabling communication between Users and Vendors
3. User Acknowledgement and Consent
By proceeding with any booking, the User confirms that:
They have read and understood all trip details
They agree to Vendor-specific terms and policies
They accept all risks associated with travel
They consent to sharing their details with Vendors
4. User Responsibilities
The User shall:
Provide accurate and complete information
Review trip details, inclusions, and exclusions carefully
Comply with Vendor instructions and safety guidelines
Ensure possession of valid identification documents
5. Bookings and Payments
Booking is confirmed only after successful payment
Prices may change based on availability
The Platform may act as a payment facilitator
The Platform does not guarantee:
Availability
Pricing accuracy (in case of errors)
6. Cancellation and Refund Policy
Cancellation and refund policies are determined by the Vendor. The Platform shall not be responsible for:
Refund delays
Partial refunds
Disputes between User and Vendor
7. Limitation of Liability
To the fullest extent permitted by law, the User agrees that the Platform shall not be liable for:
7.1 Personal Risk
Injury, illness, disability, or death
Medical emergencies
7.2 Property Loss
Theft, damage, or loss of belongings
7.3 Service Issues
Delays, cancellations, or rescheduling
Service quality issues
Misrepresentation by Vendor
7.4 Third-Party Actions
Negligence or misconduct of Vendors
Actions of co-travelers or third parties
7.5 External Factors
Weather conditions
Government restrictions
Natural disasters
8. Assumption of Risk
The User acknowledges that travel inherently involves risks. Adventure and outdoor activities carry additional risks. The User voluntarily agrees to participate at their own risk.
9. Indemnity
The User agrees to indemnify and hold harmless the Platform against:
Claims arising from User actions
Misuse of services
Violations of this Agreement
10. Vendor Relationship
The User enters into a direct contract with the Vendor
The Platform is not a party to the service agreement
Any dispute must be resolved directly with the Vendor
11. Force Majeure
The Platform shall not be liable for failure due to:
Natural disasters
Pandemic
Government orders
Unforeseen events
12. Data and Privacy
User data shall be handled as per the Platform's Privacy Policy.
13. Prohibited Activities
The User shall not:
Provide false information
Misuse the Platform
Engage in fraudulent activity
14. Termination of Access
The Platform reserves the right to suspend or terminate access and cancel bookings in case of misuse.
15. Limitation of Platform Liability (Financial Cap)
Even in cases where liability arises, the Platform's liability shall be limited to the service fee or commission earned from that specific booking only.
16. Dispute Resolution
Parties shall attempt amicable resolution. Failing which, disputes shall be resolved under Indian law.
17. Governing Law and Jurisdiction
This Agreement shall be governed by the laws of India. Jurisdiction: Bareilly, Uttar Pradesh, India.
18. Modification of Terms
The Platform reserves the right to update this Agreement at any time.
19. Acceptance
By proceeding with booking, the User confirms acceptance of all terms, understanding of risks, and agreement to liability limitations.
