User Agreement

1. Introduction

This User Agreement (“Agreement”) governs the access and use of services provided by TravelDekho Services Pvt. Ltd., operating under the brand name “TripDekho” (hereinafter referred to as the “Platform”).

By accessing the Platform, browsing, or completing any booking, the User expressly agrees to be legally bound by this Agreement.

2. Platform Role (Critical Disclosure)

The User expressly acknowledges and agrees that:

• TravelDekho (TripDekho) is solely a technology-based aggregator and intermediary platform
• The Platform does not own, manage, control, or operate any travel services
• All travel services are provided by independent third-party vendors

The Platform's role is limited to:

• Providing listing and discovery
• Facilitating bookings
• Enabling communication

3. User Acknowledgement and Consent

By proceeding with any booking, the User confirms that:

• They have read and understood all trip details
• They agree to Vendor-specific terms and policies
• They accept all risks associated with travel
• They consent to sharing their details with Vendors

4. User Responsibilities

The User shall:

• Provide accurate and complete information
• Review trip details, inclusions, and exclusions carefully
• Comply with Vendor instructions and safety guidelines
• Ensure possession of valid identification documents

5. Bookings and Payments

• Booking is confirmed only after successful payment
• Prices may change based on availability
• The Platform may act as a payment facilitator

The Platform does not guarantee availability or pricing accuracy (in case of errors).

6. Cancellation and Refund Policy

Cancellation and refund policies are determined by the Vendor. The Platform shall not be responsible for refund delays, partial refunds, or disputes between User and Vendor.

7. Limitation of Liability (Maximum Protection)

To the fullest extent permitted by law, the User agrees that the Platform shall not be liable for:

7.1 Personal Risk

• Injury, illness, disability, or death
• Medical emergencies

7.2 Property Loss

• Theft, damage, or loss of belongings

7.3 Service Issues

• Delays, cancellations, or rescheduling
• Service quality issues
• Misrepresentation by Vendor

7.4 Third-Party Actions

• Negligence or misconduct of Vendors
• Actions of co-travelers or third parties

7.5 External Factors

• Weather conditions, natural disasters
• Government restrictions

8. Assumption of Risk

The User acknowledges that travel inherently involves risks. Participation in travel or adventure activities is voluntary and at the User's own risk.

9. Indemnity (Legal Shield)

The User agrees to indemnify and hold harmless the Platform against:

• Claims arising from User actions
• Misuse of services
• Violations of this Agreement

10. Vendor Relationship

The User enters into a direct contract with the Vendor. The Platform is not a party to the service agreement. Any dispute must be resolved directly with the Vendor.

11. Force Majeure

The Platform shall not be liable for failure due to natural disasters, pandemic, government orders, or unforeseen events.

12. Data and Privacy

User data shall be handled as per the Platform's Privacy Policy.

13. Prohibited Activities

Users shall not:

• Provide false or misleading information
• Engage in fraudulent transactions
• Misuse the Platform

14. Termination of Access

The Platform reserves the right to suspend or terminate access and cancel bookings in case of violations.

15. Limitation of Platform Liability (Financial Cap)

In any event, the Platform's liability shall be limited to the commission or service fee earned by the Platform for the specific booking.

16. Dispute Resolution

Users shall attempt to resolve disputes with Vendors directly. The Platform may assist but is not responsible for resolution.

17. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India. All disputes shall be subject to the jurisdiction of courts in India.

18. Modifications to Terms

The Platform reserves the right to update these Terms at any time. Continued use implies acceptance of updated Terms.

19. Entire Agreement

These Terms constitute the entire agreement between the User and the Platform.

20. Acceptance

By using the Platform, the User confirms acceptance of all terms mentioned herein.
